Authorizing amendments to the "Regulations Governing Vending on the State Street Mall/Capitol Concourse" to allow licensed arts and crafts vendors to sell books or publications that the vendor has illustrated.
Body
WHEREAS, Section 9.13(6) of the Madison General Ordinances provides that the Vending Oversight Committee (VOC) is empowered to promulgate regulations not inconsistent with Sec. 9.13, governing the sale of goods and personally prepared food on the State Street Mall/Capitol Concourse;  and the number, size, location of vending sites therein; and
WHEREAS, pursuant to Sec. 9.13 the Common Council must approve certain regulations promulgated by the VOC; and
WHEREAS, said regulations are currently published in documents entitled "Regulations Governing Vending on the State Street Mall/Capitol Concourse;" and
WHEREAS, at its meetings on April 30 and June 25 2008,   the VOC promulgated amendments to the Regulations Governing Vending on the State Street Mall/Capitol Concourse as described below; and
WHEREAS, said amendments are set forth in this Resolution using underlines and strike-outs to show changes as appropriate.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council approve amendments to the "Regulations Governing Vending on the State Street Mall/Capitol Concourse" recommended by the VOC, as follows:
 
1.       Amending the PROVISIONS FOR SPECIFIC HANDCRAFTED GOODS, as follows:
 
BOOKS AND PUBLICATIONS.  
 
All writing must be original work of the author-vendor (except for books or publications illustrated entirely by a licensed artist-vendor, as allowed under "Painting and Drawing.")  and All sales must be made with the author-vendor (or artist-vendor for illustrated books/publications) present at the vending site.  
 
PAINTING AND DRAWING.
 
All work must be conceived and executed by the artist-vendor. Personally signed lithographs of original work will be allowed. Vendors may paint or draw their own original designs onto existing, non-handcrafted objects such as canvas, paper, picture frames, candle sticks, T-shirts, ceramics and pottery.  A currently licensed arts and crafts vendor whose artwork is used to illustrate a book or other publication may also offer for sale that book or publication if the artist-vendor is the sole illustrator of the book/publication and if the artist-vendor is externally credited by name on the cover of the book/publication.   but Alterations to another artist's existing work or reproductions of another artist's work, including but not limited to alterations to photographs, paintings, drawings or postcards; are not allowed.  Commercially manufactured stencils, decals, appliques, patches or stickers may not be used.  All sales must be made with the artist-vendor present at the vending site.
