Title
To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE Mall/Concourse vending licenses on July 16, 17 and 18, 2010 in the areas specified below for the benefit of the Greater State St. Business Association (GSSBA), so that MAXWELL ST. DAYS may occur.
Body
WHEREAS, Section 9.13 (6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and
WHEREAS, Section 9.13 (6)(k)1. allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and
WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and
WHEREAS, MAXWELL ST. DAYS is such a special event; and
WHEREAS, the GSSBA agrees to obtain a Street Use Permit for the setup and conduct of this event on July 16, 17 and 18, 2010 and agrees to comply with the conditions of the permit, including but not limited to, any conditions placed on the permit by the Street Use Staff Commission; and
WHEREAS, the sponsor of the event, GSSBA, wishes to insure the integrity, comprehensiveness and success of MAXWELL ST. DAYS by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Common Council; and
WHEREAS, the sponsors agree to comply with all recommendations of the Street Use Staff Commission and the Vending Coordinator concerning the location of vending sites and use of electricity; and
WHEREAS, street vending, Mall/Concourse vending licenses and sidewalk cafe licenses will be invalidated at this location not more than ten times in the year 2010, including this event;
NOW, THEREFORE, BE IT RESOLVED, that the Common Council hereby SUSPENDS for the above-mentioned dates and times, the vending restrictions relating to handcrafted goods and personally prepared food set forth in Sec. 9.13(6)(b) (except that all merchant vendors will continue to be limited to vending goods traditionally, customarily and currently sold on their business premises) with said suspension occurring for event participants on the following portions of streets and sidewalks:
100 to 600 blocks of State St., 200 N. Henry St. and the area directly in front of 711 State St.
