Fiscal Note
The 2019 Adopted Budget approved transferring the City’s treasury function from a standalone agency to a service within the Finance Department. Under this newly approved structure, the duties previously performed by the City Treasurer will now be performed by the Finance Director Department. The responsibilities of the City Treasurer will be performed by through a newly created Treasury and Revenue Manager that will report to the Finance Director. There is no fiscal impact associated with this change.

SUBSTITUTE CHARTER - Amending Section 3.055 of the Madison General Ordinances to transfer the functions of the City Treasurer to the Finance Director Department.

DRAFTER'S ANALYSIS: This is a related ordinance to Legistar No. 54146, to transfer the functions of the City Treasurer to the Finance Director. A separate ordinance is needed because this section was adopted as a Charter Ordinance. By this ordinance, the remaining provisions of Sec. 3.055 will become a standard ordinance and will not require a Charter Ordinance for future amendment.
These changes are all to be effective July 1, 2019.
If adopted, the Charter provisions of this ordinance shall take effect 60 days from the date of passage and publication, subject to the referendum procedures of Wis. Stat. § 66.0101(5).

The Common Council of the City of Madison do hereby ordain as follows:
1. Sec. 3.055 entitled “City Treasurer” of the Madison General Ordinances is amended to read:
“3.055 CITY TREASURER FUNCTIONS TRANSFERRED TO FINANCE DEPARTMENT.
(1) The office of functions and duties of the City Treasurer, as provided in Wis. Stat. §62.09(9), is are hereby transferred to the Finance Department .established to perform the duties of the Treasurer as provided as in Wis. Stat. § 62.09(9). The Finance Director shall manage and supervise the City Treasurer functions shall be appointed by the Mayor, subject to the approval of the Common Council and shall be a managerial employee within Sec. 3.54(9), MGO. The City Treasurer functions, to be housed in the Finance Department shall be to collect and account for all taxes, license monies, fees, accounts of charges due or owing to the City, and also shall be responsible for the collection, receiving, safekeeping, and accounting for all monies and securities of the City of Madison and attend to all related treasury affairs, and shall perform such other duties as are required by State law, City ordinance or the Mayor. The City Treasurer person or persons performing the duties of City Treasurer shall report to the Finance Director, shall take an oath of office to perform faithfully and impartially the duties of the office and shall execute the bond required by Section 3.31(1), MGO.
(2) Whenever in state law or these ordinances reference is made to a duty or responsibility of the City Treasurer, it shall be read to mean the person(s) performing the City Treasurer functions in the Finance Director Department.
(3) Sec. 3.055(1), MGO, was adopted as a Charter Ordinance. Therefore, this amendment is being adopted as a Charter Ordinance, but hereafter, this section shall be treated as a standard ordinance.
This is a Charter Ordinance which requires adoption by two-thirds of all the members of the Common Council and which shall take effect sixty (60) days following passage and publication, subject, however, to the referendum provisions of Wis. Stat. § 66.0101(5).”
2. This Ordinance takes effect on July 1, 2019.
