Reconsideration of Request by Madison Mallards for Approval of 2024 Fireworks Display Schedule at Warner Park Stadium

At the March 13, 2024, Board of Park Commissioners meeting, the Madison Mallards were approved for 2 shows for softball, with at least one of the softball shows a full fireworks show. The motion also indicated that the June 28 show would require that the show be approved by the DNR, or the show would be moved to an August date (Legistar File 82420). The DNR has indicated that they will not issue a letter of approval, as it is out of their jurisdiction, and that the Bald and Golden Eagle Protection Act (16 U.S.C. 668-668d) is the jurisdiction of the U.S. Fish and Wildlife Service. The U.S. Fish and Wildlife Service Midwest Migratory Bird Program has recommended that the fireworks show wait until after the eaglets have fledged and are able to fly away if startled. The Madison Mallards are requesting authorization that the June 28 fireworks show be allowed if the chicks have fully fledged as confirmed by the Madison Parks Rangers. This request is in addition to the 6 fireworks displays approved by the Board of Parks Commissioners at the February 14, 2024, meeting (Legistar # 82017).
