The proposed resolution authorizes an amendment to a contract for legal services related to the State Street Campus Garage redevelopment. The total compensation under the contract is amended to not exceed $115,000 and was previously not to exceed $49,999. The contract will be paid from the State Street Campus Garage Replacement project within Parking's approved capital budget.

Body
WHEREAS, pursuant to RES-22-00823, Legistar File No. 74679 and RES-23-00488 Legistar File No. 78329, the City entered into a development agreement with Mortenson Development for the redevelopment of the Lake Street side of the State Street Campus Parking Facility into a mixed-use development, which will include a new public parking ramp, approximately 220 apartments with 100 beds set aside with reduced rent, and an intercity bus terminal; and

WHEREAS, the project involves a complex public-private partnership, multi-phased construction, and the creation of a condominium, and the City often hires outside counsel to assist with the creation of condominiums; and

WHEREAS, Attorney Jenifer Kraemer and von Briesen & Roper, S.C. have the required specialized knowledge and expertise on these specific types of issues having represented parties in similar projects, including those involving the City; and

WHEREAS, under MGO Sec. 4.26(4)(a)3., the City may retain services of an attorney without competitive bids; and

WHEREAS, the City has an existing purchase of services contract with von Briesen & Roper, S.C. to provide legal services for this project up to an amount of $49,999, and the complexities of the project and representation require additional legal services.
