Fiscal Note

The proposed resolution authorizes the execution of an ingress/egress easement agreement with and the acceptance of a quit claim deed from the Madison Metropolitan Sewerage District. No additional City appropriation required.

Authorizing the City of Madison to execute an Ingress and Egress Easement Agreement with, and accept a Quit Claim Deed conveyance of land from, Madison Metropolitan Sewerage District, for purposes related to the anticipated Madison Public Market. (District 12)

Body

WHEREAS, the design of the future Madison Public Market (“Market”) site, located at 202 N. First Street, requires the City of Madison (“City”) to acquire easement rights for ingress and egress purposes (“Easement”) over a portion of adjacent land owned by Madison Metropolitan Sewerage District, as legally described and depicted in attached Exhibit - Easement, located at 104 N. First Street (“MMSD Property”); and

 

WHEREAS, the Market site design also requires ownership of the portion of the MMSD Property legally described and depicted on attached Exhibit - Quit Claim Deed to be conveyed to the City.

 

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the City’s execution of the Easement, substantially, though not exclusively, on the terms and conditions detailed in the Easement, attached to this resolution as Exhibit - Easement.

 

BE IT FURTHER RESOLVED that the Common Council of the City of Madison authorizes the City’s acceptance of the Quit Claim Deed, substantially, though not exclusively, in the form of the Quit Claim Deed attached to this resolution as Exhibit - Quit Claim Deed.
