Fiscal Note

The proposed resolution authorizes a contract with Meyer Scherer & Rockcastle, Ltd for the completion of architectural design and construction administration services for the Madison Public Market. The total contract amount is $306,349, of which $174,953 is scope that was not completed prior to expiration of previously authorized contract #8048 and $131,396 is newly added services. Existing authorized funds in the Madison Public Market project (Munis project #10069) support the proposed Purchase of Service Agreement.  No additional City appropriation required.

Authorizing a noncompetitive contract for Purchase of Services (Architect) with Meyer Scherer & Rockcastle, Ltd to complete professional architectural and engineering design, construction administration, and warranty services for the construction of the Madison Public Market. (District 12)

 

Body

WHEREAS the parties, the City of Madison(“City”) and Meyer Scherer & Rockcastle, Ltd (“Architect” or “Contractor”) entered into a contract for the purchase of professional architectural design and Construction Administration services for the Madison Public Market project on February 25, 2019 (RES-19-00093, File ID 54211, Contract#: 8048); and,

 

WHEREAS the original contract was competitively selected through the RFP process; and,

 

WHEREAS Contract# 8048 received 4 amendments totaling $74,940; and,

 

WHEREAS Contract# 8048 Total Contract Amount, including amendments, is $1,191,379; and,

 

WHEREAS Contract#: 8048 had a TERM AND EFFECTIVE DATE of March 05, 2019 through December 31, 2022; and,

 

WHEREAS Contract# 8048’s Term expired on December 31, 2022; and,

 

WHEREAS the remaining services originally within the Scope of Services of Contract# 8048, but not yet complete totaled $174, 953; and,

 

WHEREAS due significantly to continued delays in the project, extra services (i.e. Remobilization, Billing Rate Increase, Document Revisions, Site Improvement revisions, and Storm Water certifications) totaling $131,396 are required to complete professional Architect and Engineer Construction Administration and Warranty services for Madison Public Market project; and,

 

WHEREAS the total compensation under this new Contract to complete the professional architect and engineer services for Madison Public Market is $306,349. Of that amount, $174, 953 was part of the original competitive selection process, while the additional services of $131,396 were not; and


WHEREAS the term of the new contract shall be through completion of construction and warranty period, estimated at June 30, 2026; and

 

WHEREAS, City desires to enter into a contract with the Architect in an amount not to exceed $306, 349 to provide remaining Services not complete by Contract# 8048 and additional design services required in the Construction and Warranty phases of the Madison Public Market project; and

 

WHEREAS, under sec. 4.26(4)(b), of the Madison General Ordinances if the aggregate amount of the fee for services will be $50,000 or more and the contract was not subject to a competitive bidding process, the contract shall meet one of the other requirements of sec. 4.26(4)(a) and be approved by the Common Council; and

 

WHEREAS, for the reasons stated in the attached Noncompetitive Selection Request Form, the proposed contract with the Architect meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and

money to retain the same consultant”;

 

NOW, THEREFORE, BE IT RESOLVED that the Common Council hereby authorizes the Mayor and City Clerk to execute a services contract not to exceed $306,349 with Meyer Scherer & Rockcastle, Ltd. for the above described services.
