Legislative file #72870 passed in September of 2022 authorized a contract for a fare collection project within Metro Transit not to exceed $3,983,291. This resolution amends the contract amount for an additional $153,374 to support equipment and service installations on 60’ buses. This additional amount will be funded from available budget within the Transit Technology System project in Metro’s capital budget. No additional appropriation required.

WHEREAS, the City has purchased new 60’ electric bus fleet for the BRT project; and

WHEREAS, the City selected Masabi Software system from Masabi LLC through a competitive procurement process RFP# 11010-0-2022-AH,which will operate Metro fare collection; and

WHEREAS, the current contract with the City of Madison and Masabi LLC does not include service installations on the 60’ bus fleet; and

WHEREAS, Metro is in need to procure additional compatible hardware and service installations from Masabi LLC; and

WHEREAS, Masabi LLC is proprietary hardware, there are no other contractors who offer service installations for the Masabi fare collection system; and

WHEREAS, for the new fare system to operate effectively, it necessitates the installation of hardware and services that are compatible with Masabi systems and meet their specified requirements; and

WHEREAS, under MGO 4.26(4)(a) services of $50,000 or more that were not competitively selected must be approved by the Common Council and must meet one of the exceptions in MGO 4.26(4)(b); and

WHEREAS, for the reasons stated above and on the attached Noncompetitive Selection Request Form, Masabi LLC is the only firm that can provide the specific services required, thereby meeting the exception of MGO 4.26(4)(b)2., “the service required is available from only one perso...
