Updating the City’s policy for the assessment of sanitary sewer improvements to serve unsewered and sewered lands located within the current and future boundaries of the City of Madison. (Citywide)
Body
WHEREAS, the City of Madison needs to establish the conditions for connection to City sanitary sewer facilities to unsewered and sewered lands within the City of Madison, and;
WHEREAS, the use of special assessments for the extension of new sanitary sewer reduces the impact of new development on current rate payers, and;
WHEREAS, sanitary sewer improvements necessary to serve developments are in most instances completed as part of the required Developer Agreement, and;
WHEREAS, the City has established policies for the assessments of sanitary sewer improvements, and;
WHEREAS, under existing policy, even though most sanitary upsizing costs are incurred directly by developers under a Developer’s Agreement, the costs of sanitary sewer upsizing may be assessed to a developer. This assessment option, while rarely used, prevents those developer incurred costs from being eligible for tax incremental financing; and,
WHEREAS, it is necessary and appropriate for the City to update the existing Sanitary Sewer Assessment policy to remove the rarely used assessment option for sanitary sewer upsizing, to allow for possibly alternate financing options for these types of improvements.
NOW, THEREFORE, BE IT RESOLVED, that the updated City of Madison Policy for the Assessment of Sanitary Sewer Improvements, attached hereto and incorporated by reference, is hereby approved and shall be the established policy of the City regarding sanitary sewer special assessments, superseding any prior policy or resolution that is inconsistent therewith.
