Title

Amending Section 28.104(2) of the Madison General Ordinances to add an Exemption from Transit Oriented Development Requirements for Madison- and Dane County-Owned Parks.

DRAFTER’S ANALYSIS:    This ordinance change amends MGO 28.104(2) to exempt development in parks owned by the City of Madison and Dane County from the requirements of the Transit Oriented Development Overlay (“TOD”). The proposed change amends the “Applicability” section of MGO 28.104(2). This change reflects feedback that development within parks has challenges complying with TOD requirements as parks have recreation-oriented uses that drive the size and location of structures and parking within a site.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subsection (2) entitled “Applicability” of Section 28.104 entitled “Transit Oriented Development Overlay District” of the Madison General Ordinances is amended as follows:

 

“(2)                     Applicability. The TOD Overlay District is depicted on the maps below. This ordinance applies to all parcels within or partially within boundaries depicted on the map, except development in City of Madison-owned and Dane County-owned parks.”
