SUBSTITUTE: Amending Section 33.56(3) of the Madison General Ordinances to update membership composition.

DRAFTER’S ANALYSIS: This proposed Ordinance modifies the composition of the Transportation Commission. The Transportation Commission has 11 voting members made up of 4 members of the Common Council and 7 members that are Residents of the City of Madison. There are also two alternate members who are Residents of the City of Madison. The current Ordinance establishes requirements that one member must also serve on the Plan Commission, one member must also serve on the Board of Public Works and one member must also serve on the Madison Area Transportation Commission. In addition, one (1) member must be knowledgeable of equity issues and the needs of marginalized communities; one (1) member must be knowledgeable of issues facing people with disabilities; one (1) member whose primary mode of transportation in the City is the bicycle; one (1) member whose primary transportation in the City is walking; one (1) member whose primary mode of transportation in the city is transit.

This means that 8 of 11 members must either concurrently serve on another body, represent a specific mode of transportation or be knowledgeable of certain issues, unless some members fulfill more than one of these categories.

This proposed Ordinance follows the model of the Sustainable Madison Committee in Sec. 33.31 MGO. This proposed Ordinance provides that the Mayor shall strive to appoint members of certain Boards, Committees and Commissions; and that the Mayor shall also strive to appoint members who are knowledgeable of equity issues and the needs of marginal communities, who are knowledgeable of issues facing people with disabilities or who represent a specific mode of transportation.

This proposed Ordinance also staggers the terms of the initial Resident member appointments to the Transportation Commission so that the terms all of the Resident members do not expire at the same time. The proposal also specifies that terms of the Resident members on June 30th of the year in which their term ends.

 

This substitute adjusts the new provision of the Madison General Ordinances, modifying the Transportation Commission membership. The previous changes, though adopted, have not yet taken effect. The Transportation Commission has 11 voting members made up of 4 members of the Common Council and 7 members that are Residents of the City of Madison. There are also two alternate members who are Residents of the City of Madison. The current Ordinance establishes requirements that one member must also serve on the Plan Commission, one member must also serve on the Board of Public Works and one member must also serve on the Madison Area Transportation Commission.

The newly adopted ordinance adjusted the membership requirement of the newly created Transportation Commission. As in the current ordinance language, this substitute retains the current requirement that the Commission membership must include one member who must be knowledgeable of issues facing people with disabilities; one member whose primary mode of transportation in the City is the bicycle; one member whose primary transportation in the City is walking and one member whose primary mode of transportation in the city is transit. The substitute proposal adjusts the current ordinance language to strongly recommend to the highest extent practicable that the Mayor also appoint members of other City bodies directly related to transportation policy and implementation, including a member of the Plan Commission, member of the Board of Public Works; and a member who is also a member of the Greater Madison MPO Policy Board to the Commission.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subsection (3) entitled “Composition” of Section 33.56 entitled “Transportation Commission” of the Madison General Ordinances is amended as follows:

 

“(3)                     Composition.

(a)                     Members.

1.                     The Transportation Commission shall have eleven (11) voting members and two (2) alternate members to serve without compensation. The Voting Members shall include four (4) members of the Common Council, and seven (7) residents of the City of Madison. The two (2) alternate members shall be residents of the City of Madison. The term of any Alder shall expire with the expiration of their term in office.

2.                     Each member of the Commission must be capable of and committed to holding a multi-element, system-wide perspective on transportation issues. The Mayor shall appoint members who meet the following requirements to the highest extent practicable, and each Member shall be a person of recognized experience and qualifications. Members shall, collectively, represent the following areas of expertise. One (1) member must be knowledgeable of equity issues and the needs of marginalized communities; one (1) member must be knowledgeable of issues facing people with disabilities; one (1) member whose primary mode of transportation in the City is the bicycle; one (1) member whose primary transportation in the City is walking; one (1) member whose primary mode of transportation in the city City is transit. Moreover, one (1) member must be knowledgeable of equity issues and the needs of marginalized communities; one (1) member must be knowledgeable of issues facing people with disabilities; one (1) member whose primary mode of transportation in the City is the bicycle; one (1) member whose primary transportation in the City is walking; one (1) member whose primary mode of transportation in the city is transit; The Mayor shall make every effort to appoint members who represent the following perspectives or experiences: people knowledgeable about equity issues and the needs of marginalized communities; people with disabilities; bicyclists; walkers; and transit users. one (1) member must be a member of the The Mayor shall also strive to It is strongly recommended to the highest extent practicable that the Mayor appoint members of other City Boards, Commissions, or Committees directly related to transportation policy and implementation, including a member of the Plan Commission; a member of the one (1) member must be a member of the Board of Public Works; a member of the Sustainable Madison Committee and a member of the and one (1) member who is also a member of the Greater Madison Area MPO Policy Board; Policy Board. The Mayor shall give strong consideration to appointing an individual who is also a member of the and Sustainable Madison Committee. A single member may satisfy more than one of these requirements. For example, a Plan Commission member whose primary mode of transportation is bicycle can satisfy both of the requirements above. Alternate members may satisfy the above requirements.

3.3.                     For any remaining resident appointments, preference should be given to appointing people of under-represented groups; one (1) additional member whose primary mode of transportation in the city is the bicycle; and one (1) additional member whose primary mode of transportation in the city is transit. (b)                     Appointment and Terms of Common Council Members. Common Council members of the Transportation Commission shall be appointed by the Mayor subject to confirmation by the Common Council. Terms for Common Council members shall coincide with their terms on the Common Council. Appointments for such terms shall be made at the organizational meeting of the Common Council on the third Tuesday in April or as soon thereafter as the Mayor makes the appointment.

(c)                     Appointment and Terms of Resident Members and Alternate Resident Members. Resident Members and Alternate Resident Members shall be appointed by the Mayor subject to confirmation by the Common Council, and shall have a term of three (3) years, except that when the Board Commission members are initially appointed, Resident Members and Alternate Resident members shall have staggered terms, as provided in Subdivision (ce). Resident Members and Alternate Resident Members of the Transportation Commission shall be residents of the City of Madison at the time of appointment and throughout the Member's term. Terms shall expire June 30th for Resident Members. Terms of the four Alder Members shall expire with the expiration of their terms as Alders. The term of the Board of Public Works member shall expire with their term on the Board of Public Works. The term of the Madison Area Transportation Policy Board shall expire with their term on the Madison Area Transportation Policy Board. The Term of the Plan Commission Member shall expire with their term on the Plan Commission. The term of any Member appointed to the Transportation Commission who is also a member of the Sustainable Madison Committee shall expire with their term on the Sustainable Madison Committee.

(d)                     Role of Alternate Members. The first alternate member shall act with full power when any other member of the Transportation Commission is absent or is unable to act because of a conflict of interest. The second alternate member shall so act only when the first alternate refuses or is absent or when more than one member of the commission is so unable or is absent. In addition, alternates may participate in Transportation Commission discussion and serve on subcommittees or as commission representative on other City boards, commissions, or committees Boards, Commissions, or Committees at any time.

(e)                     Terms. Members shall have staggered three-year terms, except that when the Board Commission is initially created and filled, four (4) three (3) Resident Members shall be appointed for three-year terms, four (4) three (3) Resident Members shall be appointed for two-year terms, and three (3) Members, including the two (2) alternate Members, one (1) Resident Member shall be appointed for a one-year term and the two (2) alternate Resident Members shall be appointed for one-year terms.”
