Repealing Section 12.02 of the Madison General Ordinances.

DRAFTER’S ANALYSIS:    This ordinance repeals Section 12.02 which created a Traffic Bureau. There is no statutory requirement to have a Traffic Bureau created by ordinance, nor are other specific aspects of the police department created by ordinance. All aspects of this Section are addressed and covered under current ordinances and CBAs. The repeal of this section has no impact on Madison Police Department operations or personnel, it should be viewed as a housekeeping change through the elimination of an unnecessary ordinance.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Section 12.02 entitled “Traffic Bureau of the Police Department” of the Madison General Ordinances is repealed

12.02 TRAFFIC BUREAU OF THE POLICE DEPARTMENT

(1)                     The Traffic Bureau of the Police Department consists of those officers of the Police Department assigned thereto by the Chief of Police, under the supervision of a Captain of Traffic directly responsible to the Chief.

(2)                     It shall be the primary duty of the officers of the Traffic Bureau, with such aid as may be rendered by other officers of the Police Department, to enforce the provisions of this chapter and of the State Vehicle Code; to direct traffic; to investigate traffic accidents; and to cooperate with the Traffic Engineer and other officers of the City and state in the enforcement of traffic laws and in developing ways and means to improve traffic conditions.

(3)                     Officers of the Traffic Bureau, and other police officers, shall in the event of an emergency, direct traffic as conditions require notwithstanding the provisions of this chapter or the State Vehicle Code.

(5)                     The Traffic Bureau in cooperation with the Records Bureau of the Police Department shall maintain records or files of the following:

(a)                     All violations or alleged violations in this City of this chapter and of the State Vehicle Code, including a record of final disposition of all such violations so as to show the number of each type of violation. Said records shall be maintained for at least five (5) years and shall be numbered serially. Monthly and annual summaries of the dispositions of said violations shall be available to the public.

(b)                     Traffic accident reports filed alphabetically by street name and the information in such reports shall be made available to the Traffic Engineer.

(c)                     Traffic accidents, arrests, convictions, complaints and warrants, recorded alphabetically by the operator's name, for at least five (5) years.

(6)                     The Traffic Bureau shall periodically study, in cooperation with the Traffic Engineer, the records and files required by this chapter and attempt to discover the reasons for such violations and accidents and devise needed remedial measures.

(7)                     The Traffic Bureau shall annually prepare a traffic report which shall be filed with the Mayor. Said report shall contain the following information on traffic matters in this City:

(a)                     The number of accidents, the number of persons killed, the number of persons injured and other pertinent accident data.

(b)                     The number of traffic accidents investigated and other pertinent data concerning the safety activities of the Police Department.

(c)                     The plans and recommendations of the Traffic Bureau for future traffic safety activities.”
