WHEREAS, MREC VH Birchwood Point, LLC has satisfactorily completed the installation of sanitary sewer and street improvements (excluding bituminous surface pavement) by private contract, in accordance with the City of Madison Standard Specifications for Public Works Construction, in: Birchwood Point, Phase 5
NOW, THEREFORE, BE IT RESOLVED
1. That said sanitary sewer and street improvements (excluding bituminous surface pavement) be and are hereby accepted.
2. That said sanitary sewer improvements are hereby assigned to the Madison Sewer Utility for ownership and maintenance and that the attached Schedule "A" representing the actual cost of construction of these improvements shall be reflected in the Madison Sewer Utility's "Utility Plant In Service".

3. That the street improvements, excluding the bituminous pavement, on the following streets be and are hereby accepted:
• Windy Peak Road from the south property line of Lot 167 to the east property line of Lot 168 (existing street)
The attached Schedule "A" representing the actual cost of construction of these improvements, which shall increase the street infrastructure value for Project No. 11304 $31,150.08 for a useful life of 40 years.
