Amending Section 8.17(6) of the Madison General Ordinances to Create a Parks Vending Permit Exception for Certain Parks Division Sponsored Events.

DRAFTER’S ANALYSIS: Any person setting up a vending stand, to display any foods, beverages, goods or information regarding services or lessons, or who sells any foods, beverages, goods, services or lessons, on City park property must obtain a parks vending permit under Sec. 8.17. Requirements of this permit are that the vendor provide proof of adequate insurance, and that they indemnify the City for any liability arising out of their actions. The Parks Division has historically sponsored small craft and vendor fairs at some of its facilities. Many of those vendors would not able to obtain the necessary insurance to obtain a permit. To continue to allow these Parks Division sponsored events, an exception to the Parks vending permit is being created to exclude participants in these craft and vendor fairs, with the Risk Manager’s approval.

The Common Council of the City of Madison do hereby ordain as follows:
1. Section 6 of Section 8.17 entitled “Vending in Public Parks” of the Madison General Ordinances is amended as follows:
(6) Recreation programs sponsored or conducted by the Madison Metropolitan School District and participants in Parks Division sponsored craft or vendor fairs, with the approval of the City’s Risk Manager, are exempt from the provisions of this section.
