Title

Authorizing City Engineer or designee to sign the Enel X Way USA, LLC Nondisclosure Agreement required to use certain software as part of a managed Electric Vehicle (EV) charging network. (Citywide)

Body

WHEREAS, the City of Madison is participating in a Department of Energy Grant program called Connected Communities; and

 

WHEREAS, the Connected Communities grant is tasked with exploring Grid-Interactive Efficient Buildings, including managed electric vehicle charging; and

 

WHEREAS, the City of Madison already uses some Enel X Way USA, LLC products for electric vehicle charging, but not to the extent required by the grant; and

 

WHEREAS, a nondisclosure agreement is required to be signed to explore the use of the advanced features of the Enel X Way USA, LLC managed electric vehicle software; and

 

WHEREAS, the nondisclosure agreement will be reviewed by the City Attorney’s office for compliance with City rules and policies; and

 

WHEREAS, the nondisclosure agreement’s duration is for three years from receipt of the managed electric vehicle charging software trial.

 

NOW, THEREFORE, BE IT RESOLVED, that the City Engineer, or their designee, is authorized to sign and submit a nondisclosure agreement with Enel X Way USA, LLC to use its managed electric vehicle charging software, in a form and manner that is approved by the City Attorney.
