The proposed ordinance amendment creates a grace period for Town of Madison residents to comply with smoke alarm requirements. No appropriation is required.

DRAFTER’S ANALYSIS:    This ordinance creates a grace period for residential buildings in the areas of the Town of Madison attaching to the City effective October 31, 2022 with respect to the City’s smoke alarm ordinance, MGO 34.907. Without this ordinance, all buildings in the Town of Madison not already in compliance MGO 34.907 would immediately be out of compliance on the date of attachment. This ordinance specifies that owner occupied single family homes in the former Town of Madison will have until December 31, 2023 to comply with MGO 34.907, and all other residential buildings have until July 1, 2023 to comply with MGO 34.907. The amendments in this ordinance are intended to address only those residences joining the City of Madison by attachment of the Town of Madison, It is not intended to modify in any way the smoke alarm requirements for residences already in the City of Madison.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Paragraph 2. of Subdivision (b), entitled “Required Installation” of Subsection (1) entitled “Smoke Alarms” of Section 34.907 entitled “Fire Alarm and Detection Systems” of the Madison General Ordinances is amended as follows:

 

“2.                     On August 15, 2009 all owners of residential buildings, except owner-occupied single family homes, shall install and maintain a smoke alarm in each bedroom, in every sleeping area and within six (6) feet of each door leading to a bedroom or sleeping area of each unit and on each floor of the building. This subdivision does not apply to owners of hotels and motels.
Effective November 1, 2022, all owners of residential buildings attached to the City from the Town of Madison at 11:59 p.m. on October 30, 2022, except owner-occupied single family homes, shall install and maintain a smoke alarm in each bedroom, in every sleeping area and within six (6) feet of each door leading to a bedroom or sleeping area of each unit and on each floor of the building on or before July 1, 2023.

 

 

                     2.                     Paragraph 4. of Subdivision (b), entitled “Required Installation” of Subsection (1) entitled “Smoke Alarms” of Section 34.907 entitled “Fire Alarm and Detection Systems” of the Madison General Ordinances is amended as follows:

 

 

“4.                     Owner-Occupied Single Family Homes. It shall be the responsibility of the owner of an owner-occupied single family home to install smoke alarms as required by sub. (1)(a) and sub. (1)(b) of this ordinance by August 15, 2010.
Effective October 31, 2022, the owner of an owner-occupied single family home attached to the City from the Town of Madison at 11:59 p.m. on October 30, 2022 shall install smoke alarms as required by sub. (1)(a) and sub. (1)(b) of this ordinance by December 31, 2023.
