Fiscal Note

The proposed ordinance amends Section 24.02 and 1.08(3)(a) of the Madison General Ordinances to prohibit disorderly conduct directed at an election official. A companion resolution (Legistar file 72619), Supporting Election Officials’ Safety and Nonpartisan Election Administration, is also being considered.

The memo from City Attorney Michael Hass attached to the Legistar file outlines changes to forfeitures for disorderly conduct. The potential forfeiture revenue depends on the number of future convictions which cannot be determined at this time. No appropriation is required with the approval of this ordinance amendment.

DRAFTER’S ANALYSIS:    This ordinance expands Sec. 24.02, MGO, to prohibit the harassment of an individual on the basis of their status as an election official. The intent of the ordinance is to protect election officials from unprovoked harassment in both private and public spaces, and to require an increased forfeiture for violations of this nature.
