SUBSTITUTE. A Resolution amending the “Regulations Governing Vending on the State Street Mall/Capitol Concourse” to move the regulations for sidewalk cafes into new section 9.135 of the Madison General Ordinances, and to make updates consistent with new ordinances creating Roadway Cafes and making the “Streatery” program permanent.

WHEREAS, Under sec. 9.13(6)(c) of the Madison General Ordinances (to be renumbered 9.136(1)(c)) the Vending Oversight Committee (VOC) promulgates regulations governing all street vending activities in the State Street Mall and Capitol Concourse Vending Area, including sidewalk cafes and merchant vending sites; and
WHEREAS, the Common Council must approve these regulations; and
WHEREAS, the regulations are published in a document entitled “Regulations Governing Vending on the State Street Mall/Capitol Concourse;” and
WHEREAS, on February 23, 2022 the VOC will review the attached amendments to those Regulations, along with ordinance amendments that will make the “Streatery” program permanent, allowing eligible sidewalk cafes to expand into the roadway through a Roadway Cafe Expansion License and a Roadway Cafe Permit, and allowing sidewalk cafes to expand laterally on the sidewalk; and
WHEREAS, all information about Sidewalk Cafes will be consolidated into new Section 9.135, with the rules for sidewalk cafes currently found in the Mall/Concourse Regulations being moved into sec. 9.135; and
WHEREAS, the revisions shown in the attached document remove all information about sidewalk cafes from the Regulations, make updates consistent with Resolution File No. 61270 adopted on July 14, 2020, allowing umbrellas and tents for Merchant Vendors, and make corrections as needed;
NOW, THEREFORE, BE IT RESOLVED that the Common Council approves the amendments shown in the attached “Regulations Governing Vending on the State Street Mall/Capitol Concourse - File No. 69381 Changes.”
