Fiscal Note
The proposed resolution allows for the execution of cooperation agreements with neighboring jurisdictions for the East-West Bus Rapid Transit (BRT) project. These agreements provide coordination between the City of Madison and jurisdictions touched by the East-West BRT project. These agreements will assign responsibility around planning, constructing, operating and maintaining the BRT project. Expenses and funding associated with these agreements were planned within the 2022 adopted capital budget for BRT and no additional appropriation is required.

Body
The 15-mile East-West BRT project touches several jurisdictions whose approval is necessary to construct the project. These include the Wisconsin Department of Transportation, Dane County, Cities of Middleton and Sun Prairie, the Village of Shorewood Hills, the University of Wisconsin Research Park, and the University of Wisconsin-Madison. To complete the funding agreement between the City of Madison and the Federal Transit Administration (FTA), approval and cooperation is required by these jurisdictions for the successful development of the project. These agreements are to be codified into a third-party agreement.
The purpose of the third-party agreements are to provide a coordinated and unified approach to the design, funding, construction, implementation, operation, and maintenance of the East-West BRT Project. Additionally, these agreements will assign responsibility to each of the jurisdictions for planning, constructing, operating, and maintaining the BRT project. In addition, the local share of project funding for any segments entirely within another City is being paid for by that City, and that funding will be codified in these agreements.
