The 2022 cost of the proposed contract will be up $574,754, as listed in the attached non-competitive selection form. The 2022 Executive Operating Budget includes adequate funding for this contract. No additional City appropriation is required.
Title
Authorizing the Mayor and City Clerk to execute service contracts with Tyler Technologies, Inc. for continued support and maintenance services for the City’s ERP Software system, MUNIS, for five years and thereafter as needed for the useful life of the software.
Body
WHEREAS, Tyler Technologies, Inc. is the provider of the City’s Enterprise Financial and Business Processing System, MUNIS, acquired in 2010 after a competitive selection process, and includes the following software modules currently in-use: General Ledger, Accounts Payable, Accounts Receivable, General Billing and Purchasing, Payroll, HR Management, Capital and Operating Budgeting, Content Management, Utility Billing, Cashiering, Role Dashboards and Audit Trails, Treasury Management, Employee and Vendor Self Service; and
WHEREAS, the following modules will be implemented in the future and added to the list of Tyler software to be maintained and supported: the Tax Billing System, Citizen Self Service, Business License and Asset Maintenance; and
WHEREAS, all of the software must be maintained with regular updates, patches, etc. and support provided for City users and the City’s current maintenance and support contract has expired; and
WHEREAS, Tyler Technologies, Inc. is the only provider of support and maintenance of their proprietary software; and
WHEREAS, support and maintenance services funding is provided for each year as part of the adopted agency operating budgets; and
WHEREAS, the annual fee for the existing MUNIS modules is listed below and may include the possibility of additional annual fees when the 3 modules yet to be implemented are added; and
WHEREAS, under MGO 4.26(4)(a) a service contract of $50,000 or more that was not competitively selected must be approved by the Common Council and must meet one of the exceptions in MGO 4.26(4)(b) and while Tyler was selected as the provider of our enterprise financial system, an RFP was not conducted to renew the maintenance services, since there is no other vendor who can maintain Tyler’s software; and
WHEREAS, this contract meets the exception in MGO 4.26(4)(a)2., “the service required is available from only one person or firm” because only Tyler Technologies, Inc. can support and maintain its proprietary software product, as explained in the attached Noncompetitive Selection Request Form; and
NOW, THEREFORE, be it resolved that the Mayor and City Clerk are authorized to execute contract(s) for software support and maintenance services with Tyler Technologies, Inc. on a recurring basis for the useful life of the software, including a five-year contract for 2022-2026, which may include increases if modules are added during that time; and a 5% increase for future terms, pending availability of budgeted funds.
