The proposed resolution creates an alcohol ban at Allied Park, which will allow additional enforcement actions against violators of the ban. No appropriation is required.

Creating Subdivision 8.24(1)(ii) of the Madison General Ordinances to Ban Alcohol at Allied Park

DRAFTER’S ANALYSIS:  This ordinance creates an alcohol ban at Allied Park.  Temporary alcohol bans have been issued under the authority of Board of Parks Commissioners, but these park rule violations have been insufficient to address the ongoing issues at this park.  By amending the ordinance, this will make possession of alcohol in the park an ordinance violation and give the City greater enforcement tools to address the underlying issues at the park.

The Common Council of the City of Madison do hereby ordain as follows:

                     

1.                     Creating Subdivision (ii) of Subsection (1) entitled “Prohibition” of Section 8.24 entitled “Alcohol Beverage Control and Container Control on Certain Public Property” of the Madison General Ordinances as follows:

 

“(ii)                     Allied Park, except with the prior approval of the Parks Division or the Parks Superintendent.”
