Fiscal Note

There is no fiscal impact to create the classification of Police Auditor in CG21. A companion resolution (Legistar #60778) creates the position of an Independent Police Auditor in the Mayor’s Office and amends the Mayor’s Office 2020 Operating Budget to transfer funding for the position from Direct Appropriations where is was included in the adopted 2020 operating budget.

DRAFTER'S ANALYSIS:  This ordinance creates the position of Police Auditor in Section 3.03(4) Mayor in the Madison General Ordinances.

The Common Council of the City of Madison do hereby ordain as follows:

 

Subsection (4) titled "Police Auditor" of Section 3.03 entitled "Mayor" of the Madison General Ordinances is created to read as follows:

 

3.03                     MAYOR.

 

(4)                     Police Auditor. Reporting to the Mayor, the Police Auditor provides independent civilian oversight to Police Department operations to ensure police accountability to the public in an independent, unbiased manner.                      

(a)                     The Police Auditor shall be appointed by the Mayor and confirmed by the Common Council. 

(b)                     Pursuant to section 3.53(1)(i) of the Madison General Ordinances, the Police Auditor is exempt from the civil service system. Instead, the Police Auditor will serve for a term of five (5) years under a written employment agreement with renewal at the pleasure of the Mayor and confirmation by the Common Council. This position is exempt from the provisions of Section 3.54(9) of the Madison General Ordinances governing compensation of managerial employees.  Annual cost of living increases will be equivalent to those for members of Compensation Group 18.    

(c)                      For benefit purposes only, the Police Auditor shall have the same benefits as non-represented professional employees in Compensation Group 18 as may be provided and/or modified by the Madison General Ordinances, Resolution of the Common Council, Administrative Procedure Memoranda or other official City action.
