Amending Section 38.03(2)(b) of the Madison General Ordinances to amend tavern carry-out law to conform with recently revised state statutes.

DRAFTER'S ANALYSIS:  This ordinance amends tavern carry-out law to conform with recent changes to the state alcohol code and to permit unlimited carry-outs of liquor.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     Subdivision (b) of Subsection (2) entitled “Class B Licenses” of Section 38.03 entitled “License Classifications” of the Madison General Ordinances is amended to read as follows:

 

“(b)                     A "Class B" license authorizes the retail sales of intoxicating liquor for consumption on the premises where sold by the glass to be consumed on the licensed premises or in the original package or container in multiples not to exceed four (4) liters at any one time and any quantity to be consumed off the licensed premises, except that wine may be sold in the original container or otherwise in any quantity to be consumed off the premises. This paragraph does not apply to a winery that has been issued a “Class B” license. The provisions of Wis. Stats. § 125.51(3)(am)applies to all wineries that have been issued a “Class B” license.
