The Plan Commission approved a conditional use to Great American Home Improvement, LLC. for construction of a detached garage home with an accessory dwelling unit at 2022 Monroe Street (LNDUSE-2016-00083).  Great American Home Improvement paid the require park impact fees on May 10, 2018 as required per MGO Chapters 16 and 20.

 

Great American Home Improvement no longer plans to construct an accessory dwelling unit with their garage home and have requested a refund. A building permit has been issued for the garage that excludes an accessory dwelling unit (BLDNRC-2018-15905).

 

Attached is the request from Great American Home Improvement for the refund in accordance with MGO 20.11 that was forwarded to Parks by Finance, along with a copy of the deposit receipt for the impact fee payment (Parks reference ID#16143).  Though the refund request is for $2,748.64, the actual amount paid is $3,321.74. Also attached are the reports from the Parks Division and the Finance Department.

 

The Finance Director concurs with the recommendation of the Parks Division to approve the claim for a refund of $3,321.74.

 

Based upon the information presented, the Board of Public Works, pursuant to MGO 20.11(3), is to adopt a written decision either denying, approving or approving in part the claim for refund.  The Chair of the Board of Public Works should also be authorized to sign the decision so the refund can be processed.
