Fiscal Note

The proposed resolution authorizes the City Attorney to modify the Dane County Narcotics Task Force (DCNTF) agreement as necessary to maintain compliance with applicable federal guidelines. The changes relate to how DCNTF property acquired through asset forfeiture is titled and how that property would be distributed among participating agencies if the Task Force were to disband. No fiscal impact to the City is anticipated.

PREAMBLE

In 1995, the Common Council, by Resolution 52156, authorized the City of Madison to function as fiscal agent for the Dane County Narcotics Task Force. The Council also authorized the City to accept federal funding on behalf of the Task Force. In 2002, the Common Council adopted Resolution 59078; in 2006, Resolution RES-06-01004; and in 2017, Resolution RES-17-00040 extending the agreement authorizing the Dane County Narcotics Task Force. 

 

WHEREAS, rules and guidelines implemented by the United States Department of Justice and United States Treasury directly impact some aspects of Task Force operations; and,

 

WHEREAS, in 2018 the United States Department of Justice implemented guidelines inconsistent with the existing Task Force agreement; and,

 

WHEREAS, the new guidelines require modification to the existing Task Force agreement; and,

 

WHEREAS, there continues to be a significant need for the services provided by this specialized, collaborative unit of law enforcement; and,

 

WHEREAS, the Madison Police Department, Dane County Sheriff’s Office and University of Wisconsin-Madison Police Department continue to support the agreement and Task Force mission.

 

NOW THEREFORE BE IT RESOLVED, that the City Attorney is authorized to modify the Dane County Narcotics Task Force agreement as necessary to maintain compliance with applicable federal guidelines and the Mayor, City Clerk and Chief of Police are authorized to sign said modified agreements.
