Amending Resolution Enactment No. RES-17-00875, which authorizes the grant of an underground electric easement to Madison Gas and Electric Company to accommodate updates to their facilities at 115 S. Paterson Street (Madison Water Utility Operation Center). (6th A.D.)
Body
WHEREAS, on October 31, 2017, the Common Council of the City of Madison adopted Resolution Enactment No. RES-17-00875, File No. 49014, granting to Madison Gas and Electric Company (“MG&E”) an underground electric easement at 115 South Paterson Street; and
WHEREAS, such easement grant was in association with the reconstruction of the Madison Water Utility’s Operations Center at the property; and
WHEREAS, MG&E has completed the installation of its facilities and has provided an as-built legal description of their location; and
WHEREAS, the as-built legal description deviates from the description approved in Resolution Enactment No. RES-17-00875 and, therefore, such resolution needs to be amended.
NOW, THEREFORE, BE IT RESOLVED that the legal description set forth in Resolution Enactment No. RES-17-00875 is hereby deleted in its entirety and replaced with the following:
A part of Lot 1 of Dane County Certified Survey Map No. 13987 as recorded in the Office of the Dane County Register of Deeds in Volume 93 of Certified Survey Maps on Pages 205 through 208 as Document No. 5158918, being located in Government Lot 5 (NW1/4-SE1/4) of Section 13, Township 7 North, Range 9 East, in the City of Madison, Dane County, Wisconsin, described in particular as follows:
Commencing at the Easterly corner of said Lot 1; Thence North 43°52’43” West along the Northeasterly line of said Lot 1, 15.00 feet; Thence South 19°31’30” West, 11.18 feet to a point 10 feet from the Northwesterly right-of-way line of Railroad Street, as measured normally; Thence South 46°04’56” West parallel with said Northwesterly right-of-way line of Railroad Street, 104.12 feet...
