Fiscal Note

No City appropriation is required to authorize the City’s purchasing agent to execute sole-source maintenance contracts with Environmental Systems Research Institute, Inc. (ESRI) on a recurring basis. Funding for the negotiated contract will be included in future operating budgets subject to Common Council approval.

Title

Authorizing the City's Purchasing Agent to execute sole source maintenance contracts, on a recurring basis for the useful life of the software, for software support and maintenance services from Environmental Systems Research Institute, Inc. (ESRI).

Body

WHEREAS, ESRI is the sole developer and provider of support and maintenance of the City’s Geographic Information System (GIS) software; and

 

WHEREAS, the use of GIS software for many functions throughout the City has continued to grow; and

 

WHEREAS, support and maintenance services funding is provided for each year as part of the adopted agency operating budgets; and

 

WHEREAS,  under MGO 4.26(4)(a) a service contract of more than $25,000 that was not competitively selected must be approved by the Common Council and must meet one of the exceptions in MGO 4.26(4)(b); and

 

WHEREAS, the proposed contracts with ESRI meet the exception to the bidding process in section 4.26(4)(a)2 which states "The service required is available from only one person or firm".

 

NOW, THEREFORE, be it resolved that the City's Purchasing Agent is authorized to execute maintenance contracts, on a recurring basis for the useful life of the software, for software support and maintenance services from Environmental Systems Research Institute, Inc. (ESRI), at a negotiated price for future years and pending availability of budgeted funds.
