Title

Authorizing the Mayor and City Clerk to enter into a 3-year, competitively-selected Enrollment Agreement with Microsoft Corporation, and a multi-year, competitively selected master services agreement with CDW Government, LLC, a software reseller.

Body

WHEREAS,  the City has used Microsoft for Windows licenses and desktop, server and business tools  for many years and traditionally purchases licenses and support through software resellers that have been selected by the State of Wisconsin through a competitive selection process administered by the State; and,

 

WHEREAS, under MGO 4.26, the City’s competitive purchasing requirements are satisfied by making purchases from a vendor that has been selected by the State; and,

 

WHEREAS,  CDW Government, LLC (CDW-G)  is one such vendor selected by the State as a reseller of Microsoft products and services and the state’s contract includes a process for local government to participate in the state’s contract; and,

 

WHEREAS, City Information Technology plans to perform a necessary upgrade to Windows 10 for all departments; and,

 

WHEREAS,  the Finance Department also requires software called Power BI.  PowerBI will be used as a tool for the City’s data visualization efforts as part of performance excellence. Dashboards built using this tool will be used to monitor citywide data indicators and well as service level performance measurers; and,

 

WHEREAS, to participate in the State program the City must sign an Affiliate Enrollment Agreement directly with Microsoft Corporation; and,

 

WHEREAS,  the purchase is made through CDW-G as a reseller because Microsoft does not contract directly with customers under this state program; and,

 

WHEREAS,  the IT department has received a quote from CDW-G for the necessary Microsoft products and related services at a price of $156,474.00 per year for 3 years; and,

 

WHEREAS,  City IT also desires to enter into a master services agreement with CDW-G for the ongoing purchase of services to include support for the Microsoft products and other software available through the state program in the future; and

 

WHEREAS, under MGO 4.26(3)(e), service contracts of more than one year that average more than $50,000 per year in cost require Common Council approval and signature by the Mayor and City Clerk; and,

 

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are authorized to sign a master services agreement with CDW Government, LLC for the Microsoft upgrade at the price described above, and for future services; pending availability of funds in the budget and in a form approved by the City Attorney; and,

 

BE IT FURTHER RESOLVED, the Mayor and City Clerk are authorized to sign the State and Local Volume Pricing Enrollment Agreement with Microsoft Corporation for the reasons set forth below; for a period of three years,  and are further authorized to sign renewal documents with Microsoft if needed to continue this participation in the future, in a form approved by the City Attorney.
