Fiscal Note

The proposed resolution authorizes an inter-governmental agreement between the City of Madison and Dane County regarding the ongoing maintenance costs for Buckeye Road and Cottage Grove Road. The 2018 Capital Improvement Plan (CIP) assumes Buckeye Road will be reconstructed in 2019 and Cottage Grove Road will be reconstructed in 2020.

 

The proposed resolution assumes the City of Madison will assume the ongoing maintenance costs for Buckeye Road while Dane County will assume the ongoing maintenance costs for Cottage Grove Road.

 

Routine maintenance costs for Buckeye Road include:

                     Annual traffic signal & street lighting electricity costs ($3,750 annually)

                     Annual street sweeping & snow plowing costs ($91,000 annually)

                     Crack seal repairs every other year ($7,200)

                     Chip seal & crosswalk marking every four years ($67,100)

                     Full resurface every 14 years-costs split evenly with Dane County ($205,000)

 

The following items are city costs regardless of who maintains the street

 

                     Street lighting $1,500 annually

                     Street Sweeping $5,000 annually

                     Cross walk marking $16,000 every five years

 

Over a 50 year period these costs total $2.4m compared to $1.8m under the current cost sharing agreement, this calculation does not adjust for inflation. Currently, all of these costs are borne by the General Fund and Stormwater Utility.

SUBSTITUTE - Authorizing the Mayor and City Clerk to enter into an Inter-Governmental Agreement with Dane County regarding cost-sharing for reconstruction and future maintenance of Buckeye Road/CTH AB and Cottage Grove Road/CTH BB.

Body

WHEREAS, The City of Madison and Dane County wish to reconstruct Buckeye Road/CTH AB from Monona Drive to Stoughton Road in 2019 and Cottage Grove Road/CTH BB from North Star Drive to Sprecher Road in 2020 (the projects); and,

 

WHEREAS, Federal funding of $920,000 has been secured for the Buckeye/AB project through the Madison Area Transportation Planning Board (MATPB), requiring a local match of $2.62 million; and,

 

WHEREAS, Federal funding of $3.45 million has been secured for the Cottage Grove/BB project through the MATPB, requiring a local match of $2.3 million; and,

 

WHEREAS, the Federal funding cannot be utilized without a cost-sharing agreement between the City and Dane County to fund the local share, and without such agreement, the Federal funding will be diverted to other projects or lost; and,

 

WHEREAS, the City recognizes that it shares responsibility for these roadways, located within the City limits, with their owner, Dane County; and,

 

WHEREAS, the City of Madison and Dane County have spent years planning the projects and committed over $2 million for planning, design, and property acquisition for the projects. Given the time and resource investment, it would be imprudent to abandon the projects at this time,

 

NOW THEREFORE BE IT RESOLVED, that the Mayor and City Clerk are authorized to enter into an Inter-Governmental Agreement with Dane County regarding the projects, where the City and County  develop a cost sharing agreement as per the county's policy on joint projects with municipalities; and, within the following parameters:

 

The City will contribute 70% of the local share for Buckeye and 80% for Cottage Grove Road. The County will contribute the remaining portion (30% and 20% respectively) of the local share portion of the cost of reconstruction, with the remainder to be funded by Federal sources.

After completion of the projects, the City will be responsible for routine maintenance of the roadways, including snow and ice control and pavement patching.

 

BE IT FURTHER RESOLVED, that after completion of the projects, the City will be responsible for routine maintenance of County AB (Buckeye Rd) and the County will be responsible for the maintenance of County BB (Cottage Grove Rd.), including snow and ice control and pavement patching; and,

 

BE IT FINALLY RESOLVED, that within 30 days after passage of resolutions by the respective legislative bodies, the City and County will begin regular negotiations towards an agreement to address the on-going dispute on jurisdiction over county trunk highways. At the commencement of the negotiations, the parties will set a date certain for an agreement to be reached. If the parties do not reach an agreement by that date, they will mutually select a third-party that will first attempt to mediate the dispute. If the parties fail to reach agreement after 48 hours of mediation, the third-party will commence an arbitration hearing. Findings of the arbitrator would be binding on all parties.
