Dissolving this District will not have any additional costs that are not previously noted in the Intergovernmental Agreement.  All of the properties within the Town of Middleton Sanitary District #5 are currently City of Madison Sewer Utility Customers.

Dissolving the Town of Middleton Sanitary District #5.

Body

WHEREAS, on July 1, 2017, the City and the Town of Middleton entered into an Intergovernmental Agreement Relating to the Acquisition of the Town of Middleton Sanitary District #5 (see RES-17-00507, Legistar No. 47560), in which the City agreed to acquire the Town’s sanitary district (the “District”) lying in the Gammon Road, Seybold Road and Watts Road area; and,

 

WHEREAS, the District has been managed by the Town Board, acting as the Sanitary District’s commission (the “Commission”); and,

 

WHEREAS, pursuant to the terms of the agreement, which is attached and incorporated herein, following the assumption of ownership of the District’s assets and liabilities and operation of the District’s sanitary sewer system, the City is to adopt a resolution discontinuing the operation of the sanitary sewer system by the Commission under Wis. Stat. §60.79(4)(a).  It is the intent and understanding of the City and the Town of Middleton that this action will formally dissolve the District.

 

NOW THEREFORE BE IT HEREBY RESOLVED that, pursuant to Wis. Stat. §60.79(4)(a), the City, having obtained the sewerage system of the Town of Middleton Sanitary District #5 and all responsibility for serving the properties within the District, discontinues the operation of the District by the Commission, thereby dissolving the District.
