The proposed resolution authorizes the agreement with Tallgrass Land Conservation Bass Creek Weltland Mitigation, LLC at a cost of $43,500. The Stormwater Utility has available funding from prior year appropriation within the Reconstruction Streets capital program for the Portage Road project that are budgeted for this agreement.

Title
Authorizing the Mayor and City Clerk to execute an agreement with Tallgrass Land Conservation - Bass Creek Wetland Mitigation, LLC to purchase wetland mitigation credits for the City of Madison Portage Road Wetland Mitigation Project. (17th AD)
Body
The City of Madison has planned the expansion of Portage Rd between its intersection with Hayes Rd and Diloreto Ave, as well as construction of a bike path through the greenway to the east of that stretch of Portage Rd. As part of this construction, the City will need to extend a culvert that currently carries an unnamed tributary to Starkweather Creek under the intersection of Portage Rd and Hayes Rd. In addition, the City will need to re-grade and restore part of the greenway and stream so as to tie in the new culvert extension with the existing stream. The Wisconsin Department of Natural Resources (WDNR) and the US Army Corps of Engineers (USACE) have evaluated the project and determined that, to fulfill permitting requirements, the City will need to purchase 0.58 wetland mitigation credits (at a cost of $75,000/credit) from the Tallgrass Land Conservation - Bass Creek Wetland Mitigation Bank. As part of that wetland mitigation purchase, the City must execute an agreement with the Tallgrass Land Conservation to purchase the credits. The agreement is attached to this resolution.
NOW THEREFORE BE IT RESOLVED that the Common Council hereby authorizes the Mayor and City Clerk to execute an agreement with Tallgrass Land Conservation - Bass Creek Wetland Mitigation, LLC to purchase wetland mitigation credits for the City of Madison Portage Road Wetland Mitigation Project.
