The proposed resolution accepts a public sidewalk easement from Madison Area Technical College for agreed upon public sidewalk improvements located at 801 W Badger Road. No City appropriation is required.

Accepting a Public Sidewalk Easement from Madison Area Technical College across property located at 801 W. Badger Road.
Body
WHEREAS, Madison Area Technical College (the “Owner”) is the owner of the property located at 801 W. Badger Road (the “Property”); and
WHEREAS, as a condition of approval for Demolition and Conditional Use for the Madison College South Campus and in association with City Engineering Division Project No. 11916, both parties agree to the construction of public sidewalk improvements on a portion of the Owner’s Property; and
WHEREAS, in order to facilitate the construction of new public sidewalk facilities, as well as establish conditions for existing sidewalk facilities, the City Engineering Division has requested that the Owners grant to the City, at no cost, a public sidewalk easement (the “Easement”) across the Property; and
WHEREAS, the Owner has agreed to grant the required Easement to the City as a part of their redevelopment of the Property; and
WHEREAS, the City Engineering Division has reviewed and recommends acceptance of said terms of the Easement.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes acceptance of a Public Sidewalk Easement from Madison Area Technical College over the following described property (the “Easement Area”) and depicted on Exhibit A.
Easement Description
A part of Lot 2 Certified Survey Map No. 4778, Recorded on October 10th, 1985 in Volume 21 of Certified Survey Maps of Dane County on Pages 120 and 121 as Document No. 1903990, being a part of the Northeast Quarter of the Southwest Quarter of Section 35, Township 07 North, Range 9 East, City of Madison, Dane County, Wisconsin more particularly described as follows:
Commencing at the West Quarter Corner of aforesaid Section 35; Thence South 89 degrees 05 minutes 54 seconds East along the North line of the Southwest Quarter of said Section 35, a distance of 2,491.28 feet; Thence South 00 degrees 54 minutes 06 seconds West, 68.33 feet to the intersection of the southerly Right-of-Way line of West Badger Road per Transportation Project Plat No: 5992-08-21-4.03 and the northeasterly line of the remainder of aforesaid Lot 2 of Certified Survey Map No. 4778, also being the Point of Beginning;
Thence along said northeasterly line of Lot 2 South 44 degrees 27 minutes 59 seconds East, 7.17 feet; Thence North 88 degrees 03 minutes 33 seconds West, 12.43 feet; Thence North 83 degrees 36 minutes 45 seconds West, 30.44 feet; Thence North 79 degrees 59 minutes 47 seconds West, 82.40 feet to the aforesaid southerly Right-of-Way line of West Badger Road; Thence along said southerly Right-of-Way line South 81 degrees 22 minutes 34 seconds East, 82.63 feet; Thence continuing along said southerly Right-of-Way South 89 degrees 02 minutes 44 seconds East, 37.12 feet back to the Point of Beginning.
Area of above described Easement covers 232 square feet or 0.01 acres more or less.
