Fiscal Note

The proposed resolution authorizes a non-competitive contract with JX Peterbilt Madison to repair the Streets Division’s refuse truck at an estimated cost of $42,000.  The cost of the repair will be funded through existing appropriation for equipment repair in Fleet’s 2018 Adopted Operating Budget.

SUBSTITUTE - Authorizing a non-competitive contract for Sole Source purchase of service agreement for Fleet Service for the repairs of the Peterbilt refuse truck by JX Peterbilt Madison.

 

Body

WHEREAS, the City’s 2017 Peterbilt Model 320 refuse truck is inoperable due to major body damage from a traffic collision, and

 

WHEREAS, it is unclear if any insurance company will provide reimbursement, and

 

WHEREAS, the repair components include auto body work, labor time and parts from JX Peterbilt Madison, an official subsidiary of the original equipment manufacturer, the only available source, and

 

WHEREAS, the JX Peterbilt Madison quotation for up to $42,000 as the cost estimate includes the components and technical support to repair the refuse truck, and

 

WHEREAS, the refuse truck is an integral piece of equipment supporting waste collection operations for the Streets Department, and

 

WHEREAS, MGO 4.26(4) requires Common Council approval for the sole sourcing of purchases in excess of $25,000.

 

WHEREAS,  under MGO 4.26(4)(a) a service contract of more than $25,000 that was not competitively selected must be approved by the Common Council and must meet one of the exceptions to competitive bidding in MGO 4.26(4)(b); and

 

WHEREAS, for the reasons explained above, this non-competitive contract is necessary for emergency reasons as to not disturb waste collection functions at the Streets Division;

 

NOW, THEREFORE BE IT RESOLVED, that the Council approves a non-competitive contract for the sole sourcing of components and technical support from JX Peterbilt Madison to repair the refuse truck.
