The proposed ordinance amendment eliminates the existing late night vending sites and zones and creates a procedure for sites and zones to be created by Planning staff with written approval of the Chief of Police or designee. Available sites and zones must be created before April 1, 2018, the deadline for applying for a late night vending license. The dollar amounts for late night vending license fees are not amended by the proposed ordinance. No City appropriation required.

DRAFTER'S ANALYSIS: This ordinance amends the Late Night Vending License procedures to make several changes for the upcoming vending season and to phase out the current Late Night Vending areas over a period of 5 years, ending on April 14, 2023. This amendment also creates a new zone on Library Mall to begin in 2023. This amendment affects the existing late night program as follows: it eliminates the existing late night vending sites and zones and creates a procedure for sites and zones to be created by Planning staff with written approval of the Chief of Police or designee for the next 5 years. The Director of the Department of Planning and Community and Economic Development or designee (i.e. Street Vending Coordinator) must create the new sites and zones for each season before April 1, the deadline for applying for a late night vending license. Beginning with the 2018-2019 vending season, only applicants who held a Late Night Vending License in at least one of the past 2 years will be eligible to apply. Eligible applicants will be assigned to one of the newly-created sites based on seniority, although the designee may adjust site assignments to achieve an appropriate mix and balance of food / cuisine.
