Fiscal Note

The proposed ordinance change grants authority to fire inspectors to write citations for exceeding lawful occupancy capacity. Any fiscal impact is anticipated to be minimal. The Fire Department estimates less than ten citations per year.

Body

DRAFTER'S ANALYSIS:  This addition to the bail schedule gives fire inspectors authority to issue citations for capacity violations they observe and document in licensed establishments. The Madison Police Department currently has citation authority for this offense. Providing fire inspectors with citation authority for this offense allows for prompt enforcement action for capacity violations particularly in those situations where the fire department is conducting a safety inspection and the police department is not on scene.
