Fiscal Note

The proposed resolution authorizes the execution of an underground electric easement to Madison Gas and Electric Company (MG&E) for an existing cable serving facilities at Cherokee Park. No City appropriation is required.

Title

Authorizing the execution of an Underground Electric Easement to Madison Gas and Electric Company across a portion of Cherokee Park, located at 6098 North Sherman Avenue.

Body

WHEREAS, Madison Gas and Electric Company (“MG&E”) has determined that an underground electric cable serving certain facilities at Cherokee Park requires replacement due to multiple failures over the past few years; and

 

WHEREAS, as the existing cable exists without benefit of an easement, the parties desire to enter into an easement for the new cable run; and

 

WHEREAS, City of Madison Parks Division and Office of Real Estate Services staff have reviewed and approve of the granting of said easement.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Electric Easement to Madison Gas and Electric Company across a portion of Cherokee Park, located at 6098 North Sherman Avenue, legally described as follows:

 

A strip of land, ten (10) feet in width, located in part of the South ½ of the Southeast ¼ of Section 13, and part of the Northeast ¼ of the Northeast ¼ of Section 24, all in T8N R9E, City of Madison, Dane County, Wisconsin; and located in part of the Northeast ¼ of the Southeast ¼ of Section 13, T8N, R9E, Town of Westport, Dane County, Wisconsin.

 

The Easement Area shall be located 5 feet on the right side and 5 feet on the left side of the centerline of the Grantee’s Facilities as constructed.  The Facilities will be located approximately as set forth in the drawing attached hereto as Exhibit A and dated August 31, 2017.
