Title

Authorizing the City Engineer to sign and submit a Public Path Crossing Permit for the City of Madison’s Capital City Path Segments 4-6 project.

Body

The proposed project is the construction of approximately 4000’ of a paved multi-use (bike/pedestrian) path that will extend the Capital City Trail from Vondron Road to Interstate 39 on the southeast side of Madison. The majority of the path will follow the Wisconsin Department of Transportation’s railroad corridor and will include a new (non-motorized) crossing of the tracks at Wagon Trail. A Public Path Crossing Permit is required to be submitted as part of the proposed crossing of Wagon Trail.

 

The proposed indemnification language has been reviewed by the City’s Risk Manager and City Attorney. The City’s risk exposure is increased by this clause, but the exposure is covered by the City’s insurance policies, subject to their terms and conditions.

 

NOW THERFORE BE IT RESOLVED that the Common Council approves indemnification of the State of Wisconsin Department of Transportation, Wisconsin River Rail Transit Commission and its member counties, and the Operating Railroad as set forth in the permit application.

 

BE IT FURTHER RESOLVED that the City Engineer is hereby authorized to sign and submit said permit application.
