Fiscal Note

The proposed resolution accepts a temporary easement from the property owners at 1923 and 1917 Reetz Road to allow for the Stormwater Utility drainage improvement work to be conducted as planned within the Citywide Flood Mitigation capital program in 2017 (MUNIS 11513). There is no appropriation required for the acceptance of the easement.

A Resolution authorizing the Mayor and City Clerk to accept an easement from the owners of 1923 and 1917 Reetz Road to allow for drainage improvements resulting in reduced flood damage during extreme storm events. 

Body

WHEREAS, The City of Madison has been actively working on improving regional storm water flooding issues as a result of the July 21, 2016 rain event which revealed over a dozen deficiencies in our storm system ; and,

 

WHEREAS, The Common Council supported these efforts by including $1,275,000 in the 2017 Stormwater Utility budget to fund the additional projects needed; and,

 

WHEREAS, the property at 1923 Reetz Road is subject to flooding during extreme events as it is in an enclosed depression; and,

 

WHEREAS, the water from that enclosed depression drains out through an existing permanent easement down the Southside property line of 1923 Reetz Road; and,

 

WHEREAS, The owners of 1923 & 1917 Reetz Road have agreed to give the City of Madison temporary easements to improve the overflow situation in this area such that when the pipe reaches capacity the water floods down the easement instead of into the garage of 1923 Reetz; and,

 

WHEREAS, City Engineering Operations crews are able to complete this work; and,

 

NOW, THEREFORE, BE IT RESOLVED THAT:

 

That the Mayor and the City Clerk are hereby authorized to accept from ( the “Owner”), at no cost to the City, a Perpetual Easement for Public Storm Water Management Purposes in that portion of the Owner’s parcel (the “Easement Area”) more particularly described in attached Exhibit A and depicted in attached Exhibit B.
