Fiscal Note

The 2016 Parks Division Capital Budget includes $1,955,000 in GO Borrowing for the Garver at Olbrich Botanical Complex which was reauthorized to 2017 (Munis project 17133). The proposed resolution authorizes a sole source contract for professional environmental services for the Garver Feed Mill site for $75,000. Funding is available in the project.

 

Title

Authorizing the City to enter into a sole source contract with SCS Engineers for professional environmental engineering services for the Garver Feed Mill site.

 

Body

WHEREAS, in 2009, the City competitively bid for environmental consulting services to investigate and remediate the Garver Feed Mill using a $73,600 WDNR brownfield site assessment grant and SCS Engineers was awarded the contract; and

 

WHEREAS, in 2012 the City competitively bid for environmental consulting services to administer a $400,000 EPA brownfield site assessment grant and SCS Engineers was awarded the contract; and

 

WHEREAS, one of the projects completed by SCS Engineers under the grant was the initial environmental investigation on the Garver Feed Mill site (“Garver”); and

 

WHEREAS, on April 21, 2015, the City of Madison Common Council (RES-15-00334, ID #37723) accepted the proposal from Baum Development, now known as Garver Feed Mill, LLC (“Developer”) for the redevelopment of Garver; and

 

WHEREAS, based on the environmental issues that were discovered during the initial investigation completed by SCS Engineers, additional professional environmental engineering services were needed at Garver; and,

 

WHEREAS, the City entered into a purchase of services contract with SCS Engineers in 2016 for less than $25,000 to complete this work; and,

 

WHEREAS, based on the environmental issues that were discovered earlier in 2017 during the follow-up site investigation completed by SCS Engineers, the WDNR has expanded the scope of work that will be required to close the environmental investigation to include the entire North Plat; and,

 

WHEREAS, based on further investigations and site analysis, SCS Engineers has proposed a revised scope of services for professional environmental engineering services which will increase the original contract amount to $75,000, in part due to the scale of the Developer’s project; and,

 

WHEREAS, SCS Engineers has previously worked with the City on these types of environmental issues and is available to do the work in the timeframe needed; and

 

WHEREAS, under MGO 4.26(4)(b), if the aggregate amount of the fee for services exceeds $25,000 and the contract was not subject to a competitive bidding process, the contract shall meet one of the requirements of sec. 4.26(4)(a) and be approved by the Common Council; and,

 

WHEREAS, the proposed contract with SCS Engineers meets the exception to the bidding process in section 4.26(4)(a)7 which states “A particular consultant has provided services to the City on a similar or continuing project in the past, and it would be economical to the City on the basis of time and money to retain the same consultant.”

 

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk or the Designee of the Finance Director, as appropriate, are hereby authorized to enter into a contract with SCS Engineers for the purposes and at the price described above.
