Fiscal Note

The proposed resolution authorizes the granting of an Overhead and Underground Electric Easement to the Madison Gas and Electric Company across a portion of Henry Vilas Zoo at 702 South Randall Avenue. Along with a new underground line, a needed line will be added to an existing pole located on Zoo property. No City appropriation is required.

Authorizing the grant of an Overhead and Underground Electric Easement to Madison Gas and Electric Company across a portion of Henry Vilas Zoo, located at 702 South Randall Avenue.

Body

WHEREAS, Madison Gas and Electric Company (“MG&E”) is adjusting electric service to customers in the vicinity of the Henry Vilas Zoo, 702 S. Randall Avenue, and needs to install an underground line and add a line onto an existing pole located on the Zoo property; and

 

WHEREAS, the existing pole and overhead line exist without benefit of an easement, however, MG&E has prescriptive easement rights for said facilities; and

 

WHEREAS, for purposes of clearing up the easement record, MG&E has requested an Overhead and Underground Electric Easement for the pole and overhead lines and the new underground line; and

 

WHEREAS, the City of Madison Parks Division and Office of Real Estate Services staff have reviewed and approve of the granting of said easement.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Overhead and Underground Electric Easement to Madison Gas and Electric Company across a portion of the Henry Vilas Zoo property, legally described as follows:

 

A strip of land, ten (10) feet in width, located in part of the NE ¼ of Section 27, T7N, R9E, City of Madison, Dane County, Wisconsin, the centerline of said strip being more particularly described as follows:

 

The right-of-way shall be located 5 feet on the right side and 5 feet on the left side of the centerline of Grantee’s facilities as constructed. The facilities will be located approximately as set forth in the drawing attached hereto as Exhibit A.
