Fiscal Note
The proposed resolution continues an existing agreement between the State of Wisconsin Department of Transportation and the Metropolitan Planning Organization to carry out transportation related planning activities for the Madison metropolitan area. This service is included in the annual operating budget within the Planning Division. The 2017 Adopted Operating Budget for the MPO is $1,204,917, which includes $141,941 as Madison’s local match.

SUBSTITUTE - Authorizing the Madison Area Transportation Planning Board - A Metropolitan Planning Organization and Metro Transit, on behalf of the City of Madison, to enter into an agreement with the Wisconsin Department of Transportation for continuing transportation planning for the Madison Metropolitan Area.
Body
WHEREAS, various federal grants and aids are available to the Wisconsin Department of Transportation (“WisDOT”) and the Madison Area Transportation Planning Board (“MATPB”) as the designated Metropolitan Planning Organization (“MPO”) for the Madison Metropolitan Area, and various state grants and aids are available to the MPO for carrying out metropolitan transportation planning activities; and
WHEREAS, WisDOT is authorized by sec. 85.02, Wis. Stats., to direct, undertake and expend state and federal aid for planning, promotion and protection activities for all transportation modes; and
WHEREAS, the Governor of Wisconsin and local communities within the Madison Metropolitan Planning Area ("Planning Area"), through their authorized representatives, jointly designated the MATPB as the MPO to carry out metropolitan transportation planning activities for the Planning Area; and
WHEREAS, the City of Madison is responsible for providing professional staff services to the MATPB as provided for in the MPO designation agreement; and
WHEREAS, the City of Madison is the administrative and fiscal agent for the MATPB and is a legally constituted entity under the laws of the State of Wisconsin and able to receive the federal and state funding; and
WHEREAS, Metro Transit, which is owned by the City of Madison, is the area’s primary transit operator providing public transportation services within the Madison Urbanized Area; and
WHEREAS, Metro Transit is the designated recipient in the Madison Urbanized Area for federal transit operating aids under Section 5307 of the Federal Transit Act, as amended; and
WHEREAS, metropolitan transportation planning activities come under the jurisdiction of the U.S. Department of Transportation (“USDOT”), Federal Highway Administration and Federal Transit Administration, and are subject to the metropolitan planning requirements of 23 U.S.C. 134 and section 5303 of the Federal Transit Act, as amended, and implementing regulations at 23 C.F.R. 450; and
WHEREAS, the Planning Area boundaries for purposes of the federal planning provisions have been determined by agreement between the MPO and the Governor; and
WHEREAS, WisDOT and the MPO, in cooperation with Metro Transit, the transit operator, are required to undertake a continuing, cooperative, and comprehensive performance-based multi-modal transportation planning and project programming process for the Planning Area in accordance with state and regional goals, the provisions of 23 U.S.C. 134, 49 U.S.C. 5303, and 23 C.F.R. 450, and in accordance with a planning agreement; and
WHEREAS, to satisfy this requirement, WisDOT, the MATPB, and Metro Transit (the latter two on behalf of the City), wish to enter into a three-party planning agreement that identifies the roles and responsibilities of each party (WisDOT, MPO, and Metro Transit) to carry out metropolitan transportation planning activities for the Planning Area and updates the current agreement approved in 2008 to incorporate all new federal transportation planning requirements; and
WHEREAS, all MPOs in the State of Wisconsin have such a planning agreement with WisDOT and transit perators in their urban areas; and
WHEREAS, the Madison Area Transportation Planning Board approved the attached planning agreement on March 1, 2017:
NOW, THEREFORE BE IT RESOLVED that the Mayor and Common Council do hereby authorize the MATPB Chair and the Metro Transit General Manager and request the MATPB Chair to enter into an agreement with the WisDOT to carry out metropolitan transportation planning activities for the Planning Area and update the current agreement approved in 2008 to incorporate all new federal transportation planning requirements.
