DRAFTER'S ANALYSIS: On August 4, 2015, the Common Council adopted new regulations pertaining to the reuse of schools, municipal buildings, or places of worship (Legistar File 39124). In adopting these new regulations, staff inadvertently left in place additional and redundant supplemental regulations that pre-dated the new regulations. Thus, this amendment cleans up that error.

The Common Council of the City of Madison do hereby ordain as follows:

1. The Subsection entitled “Adaptive Reuse of Buildings Originally Constructed as Public Schools, Municipal Buildings, or Places of Worship” of Section 28.151 entitled “Applicability” of the Madison General Ordinances is hereby repealed.

2. The Subsection entitled “Reuse of Former School or Municipal Buildings” of Section 28.151 entitled “Applicability” of the Madison General Ordinances is amended to read as follows:

“Reuse of Former School, or Municipal Buildings or Places of Worship.
(a) Former public school or municipal buildings in residential and special districts may be adapted for the following uses with the approval of the Director of Planning and Community and Economic Development:
1. Day care centers.
2. Elementary and secondary schools.
3. Arts, technical or trade schools.
4. Colleges and universities.
5. Other public educational facilities.
6. Recreational buildings and community centers, nonprofit.
7. State or municipal offices.
8. Offices for health, medical, welfare and other institutions or organizations qualifying as nonprofit under the laws of the State of Wisconsin.
