Fiscal Note
The 2017 Adopted Capital Budget includes $250,000 funded by GO Borrowing (Munis project 17230) for the development of an implementation plan as outlined in the Fiber-to-the-Premises Analysis report (Legistar 44446). The proposed resolution authorizes a sole source purchase of services from CTC Technology & Energy for developing the implementation plan. The City's portion of the actual cost of implementation of Fiber-to-the-Premises is estimated to be $149.1 million, spread over three to five years and will be included in future years' capital budgets subject to the Council's approval at that time.

Body
WHEREAS, the Fiber-to-the-Premise project is a proposed ultra-high-speed fiber based broadband network deployed citywide; and
WHEREAS, CTC Technology & Energy is an independent communications and IT engineering consulting firm with more than 30 years of experience; and
WHEREAS, the City of Madison hired CTC Technology & Energy to complete the initial Fiber-to-the-Premise Feasibility study; and
WHEREAS, CTC Technology & Energy have intimate knowledge of the risk, ownership, business requirements and structure of a fiber to the premises network within the City of Madison; and
WHEREAS, the Common Council recently adopted a resolution (file #44446) that will allow a city staff team, with help from a consultant, to develop an implementation plan for fiber-to-the-premise; and
WHEREAS, there are no other consulting firms with the specific knowledge of the CTC Technology and Energy feasibility study: and
WHEREAS, a consultant other than CTC Technology and Energy would experience a learning curve to understand the feasibility study already completed by CTC Technology and Energy; and
WHEREAS, the bidding process would delay the implementation report (due 12/31/17) from the Digital Technology Committee to the Common Council; and
WHEREAS, City of Madison desires to enter into a contract with CTC Technology and Energy in an amount not to exceed $250,000 to provide planning services for the Fiber-to-the-Premise project; and
WHEREAS, under MGO 4.26(4)(a) a service contract of more than $25,000 that was not competitively selected must be approved by the Common Council and must meet one of the exceptions to competitive bidding in MGO 4.26(4)(b); and
WHEREAS, the proposed contract with CTC Technology and Energy meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and money to retain the same consultant”;
WHEREAS, for the reasons explained above, CTC Technology and Energy is the only consulting firm that can efficiently provide the specific needs for the City of Madison Fiber-to-the-Premise project initiative, thereby meeting the exception of 4.26(4)(b)2., “the service required is available from only one person or firm.”
NOW, THEREFORE, BE IT RESOLVED that the Common Council hereby authorizes the Mayor and City Clerk to sign a sole source contract for purchase of services from CTC Technology and Energy to provide design services to the City of Madison for the 2017 project planning report for the purposes and at the price described above.
