Title

Approving Amendment No. 1 to the Contract for the Construction of Public Improvements that Will be Accepted by the City for Eagle Crest Subdivision, Contract No. 2052 (17th AD)

Body

WHEREAS, on December 8, 2005, the developer, Eagle Aerie, LLC of Madison, Wisconsin, had entered into a Contract for the Construction of Public Improvements that Will be Accepted by the City, and;

 

WHEREAS, the Developer and the City have since mutually agreed to amend the scope of work for this project, and;

 

WHEREAS, the Developer shall pay the City $50,000 to fund the completion of the public street improvements and upon payment, the City shall reconstruction and complete the public street improvements within the subdivision as part of the Public Works Resurfacing Program in 2017, and;

 

WHEREAS, upon the payment by the Developer to the City of $50,000, the City shall release the Developer for the surety requirements of this Contract.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute Amendment No. 1 for Eagle Crest Subdivision, Contract No. 2052, with Eagle Aerie, LLC.
