Title
Authorizing the execution of a Declaration of Easement for Public and Private Utility Purposes over a portion of Thousand Oaks Park, located at 850 South Point Road.
Body
WHEREAS, Wisconsin Power & Light Company has requested a utility easement across a portion of Thousand Oaks Park located at 850 South Point Road (the “City Parcel”); and
WHEREAS, the City of Madison Parks and Engineering Divisions have reviewed and approve of an easement for such use, but also recommend that the easement be designated for use by other utilities who may have the future need to locate facilities in the easement area to serve the adjacent development (First Addition to Thousand Oaks).
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Declaration of Easement for Public and Private Utility Purposes for the benefit of all public and private utility companies registered to do business in the City of Madison for the placement of utility facilities within a portion of Thousand Oaks Park located at 850 South Point Road, more particularly described as follows (the "Easement Area"):
The north 12 feet of the east 30 feet of Outlot 1, Certified Survey Map No. 13155, as recorded on August 29, 2011, in Volume 84 of Certified Survey Maps, on Pages 237-241, as Document No. 4787425, in the office of the Register of Deeds for Dane County, Wisconsin.
The Easement Area is depicted on attached Exhibit A.
