Fiscal Note

The Fire Department’s 2016 adopted budget includes revenue for providing fire protection services to the William S. Middleton Memorial Veterans Hospital for the remainder of 2016 (MUNIS account 30110-42110) .  No appropriation is required.

Title

Approving a 6 month extension of a contract with the Department of Veterans Affairs for the Fire Department to provide services from October 1, 2016 to March 31, 2017.

Body

WHEREAS, the Madison Fire Department provides fire protection services to the William S. Middleton Memorial Veterans Hospital.  The existing 5 year contract expires September 30, 2016, a 6 month extension is necessary for all parties to assess the current contract and to evaluate the potential for future contracts; and,

 

WHEREAS, the contract requires the City to indemnify the Department of Veterans Affair for infringement of any patent, trademark or copyright arising out of performance of this contract.  This contract does not involve the use of any patent, trademark or copyright; and,

 

WHEREAS, the City of Madison wishes to continue providing services to the William S. Middleton Memorial Veterans Hospital under a contract extension for 6 months for a compensation of $24,090, with the Department of Veterans Affairs; and,

 

WHEREAS, while the indemnification clause increases the City’s exposure to risk, the City has coverage for indemnification clauses under its current insurance policy, subject to the policy’s terms and conditions; and,

 

WHEREAS, the City Attorney and the City Risk Manager have reviewed and approved the 6 month contract extension language,

 

NOW, THEREOFRE, BE IT RESOLVED, that the City accepts the terms of indemnification within the contract; and,

 

BE IT FURTHER RESOLVED, that the Council approves execution of this extension and hereby authorizes the Madison Fire Chief to sign a 6 month extension of the current contract with the Department of Veterans Affairs.
