Title

Approving a maintenance agreement for privately maintained improvements within the public right of way adjacent to 202 S Park Street - Meriter Hospital.  (13^th AD)

Body

WHEREAS, the property owner, Meriter Hospital Inc. has requested to have an underground vault installed within the S Brooks Street rights of way, and,

WHEREAS, the Meriter Hospital Inc. was required to enter into a maintenance agreement with the City for said improvements as a way to insure the public’s long term use and function of the underground vault within the rights of way as requested.

NOW, THEREFORE, BE IT RESOLVED:

1.                     That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and Meriter Hospital Inc. for the maintenance of portions of the public rights of way on S Brooks Street.

2.                     The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded as a condition of the proposed improvements.
