Fiscal Note

The proposed resolution authorizes an agreement with Janet Lounsbury for connection of her Town of Middleton property to City of Madison sanitary sewer facilities. No appropriation is required to enter into this agreement. The property owner will be responsible for all costs related to the connection of his property to the City’s sanitary sewer facilities, which are adjacent to the subject property.

Authorizing the City to enter into an attachment agreement with Janet Lounsbury for the purposes of allowing the connection of her Town of Middleton property located at 60 White Oaks Lane to City of Madison sanitary sewer facilities.

 

Body

WHEREAS Sections 10 and 14.03 of the Final City of Madison and Town of Middleton Cooperative Plan dated September 29, 2003 (the “Plan”) pursuant to Wis. Stat. §66.0307 permit a property owner in the Town to request connection to City sewer and/or water services prior to attaching the property to the City, provided that the owner agrees to pay for extension of the sewer and/or water services over a five-year period with interest, and the owner agrees to attachment to City at the end of the five-year period; and,

 

WHEREAS, Janet Lounsbury, the Owner of real property located at 60 White Oaks Lane in the Town of Middleton (hereinafter referred to as “the Property”), wishes to formally connect her existing single-family residence to City of Madison sanitary sewer facilities currently located in a public utility easement in White Oaks Lane, a private roadway serving the White Oaks subdivision; and,

WHEREAS, on March 4, 2016, the Owner submitted a petition (Legislative File ID 42058) to attach the Property to the City with an effective date of five (5) years following the effective date of the attachment ordinance as provided for in said Plan; and,

 

WHEREAS, the Property is located in the Central Urban Service Area, and is already connected to the City’s sanitary sewer main; and,

 

WHEREAS, the Owner has already paid for prior sanitary sewer service and the associated Madison Metropolitan Sewerage District connection charges and has agreed to enter into an agreement accepting the City’s terms of service and attachment of the Property to the City in five years as provided for by the Plan.

 

NOW THEREFORE BE IT RESOLVED the Mayor and City Clerk are hereby authorized to sign an Attachment Agreement for the Property, on a form approved by the City Attorney, under which the Property will be attached to the City in five years and the Property will be formally connected to the City’s sanitary sewer facilities and may also request connection to the City’s public water supply; and,

 

BE IT FURTHER RESOLVED that in accordance with Section 35.02(4)(b) of the Madison General Ordinances, the Common Council allows for the Property to connect to the Public Sewerage System of the City of Madison.
