Authorizing the acceptance of a Quit Claim Deed, at no cost to the City of Madison, dedicating land located at 603 E. Wilson Street from the City Engineering Division for public right of way purposes.
Body
WHEREAS, in 1996 the Common Council of the City of Madison approved an exchange from Louis G. Fortis to the City of Madison (the “City”) for lands located at 603 E. Wilson Street (the “Property”) by Resolution No. 52,635, ID No. 18305; and

WHEREAS, the Property was conveyed by Quit Claim Deed, recorded on May 9, 1996 as Document No. 2760948, without including the purpose of the Property for use as public right of way, resulting in the creation of a taxable parcel; and

WHEREAS, the Property has since been managed by the City Engineering Division and said Division wishes to dedicate the Property to the City to memorialize the original intent of the land swap for use of the Property as public right of way, thereby rendering the Property’s tax parcel obsolete;

WHEREAS, the City Engineering Division recommends that said dedication be accepted via Quit Claim Deed.

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of a Quit Claim Deed from the City of Madison Engineering Division for the dedication of public right of way at 603 East Wilson Street, at no cost to the City, the Property being depicted on attached Exhibit A and more particularly described as follows:

Part of Lot 2, Block 125, Original Plat of the City of Madison, located in the SE ¼ of the SW ¼ of Section 13, Township 7 North, Range 9 East, City of Madison, Dane County, Wisconsin.

Commencing at a City of Madison concrete monument with a brass cap located at the meander corner of the South quarter corner of said Section 13; thence S89° 17’49”E, 349.88 feet; thence N00° 42’11” E, 653.68 feet to the most Westerly corner of Lot 1 of the said Block 125;...
