Authorizing the Mayor and City Clerk to execute a Release of Public Water Main Easement, and accepting the Grant of new Public Water Main Easement for the public water main facilities located at 7243 Manufacturers Drive.
Body
WHEREAS, the City Water Utility has public water main facilities (the “Facilities”), located at 7243 Manufacturers Drive (the “Property”); and
WHEREAS, the owner of the Property is R&R Madison Properties, LLC, a Wisconsin limited liability company (the ”Owner”),
WHEREAS, the Facilities were to be installed within a 15’ wide public water main easement dedicated in Lot 1, Certified Survey Map No. 13917, recorded as Document No. 5133573 in the Dane County Registers Office (the “Easement”); and
WHEREAS, portions of the Facilities were incorrectly installed outside the recorded boundaries of the Easement area; and
WHEREAS, the City Water Utility recommends that the Facilities remain in place, and that the existing Easement area be released by the City, and new public water main easement be granted by the Owner; and
WHEREAS, City Water Utility and Office of Real Estate Services staff have reviewed and approve of the release of said Easement, and acceptance of new public water main easement for the Facilities as located at 7243 Manufacturers Drive.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of a 15’ foot wide Public Water Main Easement as dedicated in Lot 1, Certified Survey Map No. 13917, recorded as Document No. 5133573; and accept, from the Owner, a new 15’ foot wide Public Water Main Easement, both as located at 7243 Manufacturers Drive; and both legally described and depicted on attached Exhibit A and B.
